Premises Liability: Fall (2)

Continued from Litigation Media – Portfolio

Summary: To review photos that had been taken of the scene shortly after the accident, take additional site photos, and create a graphical presentation that shows how, why and where this accident occurred

Client: The Ritchie Law Firm (Harrisonburg, VA)

Result: With the aid of the presentation that I developed, the firm was able to obtain a pre-trial settlement from the defendant’s insurance company:

“I appreciate your willingness to come to the site and walk through the scenes with the client, so as to make sure that the presentation was accurate and effective.  Also, I found you to be prompt in your edits and easy to work with through email and phone calls.  The final product was very informative and instructive to our firm and the insurance company.  It all worked out very well for our client.”

(1) Background

On a wintry night in Harrisonburg, VA, a young woman exited her apartment via the lone walkway that leads to the parking lot.  Upon turning to her right at the end of the walkway to go to her car, she slipped and fell on black ice which, due to inadequate lighting, she could neither see nor avoid.  Her resulting injuries included a broken leg and various bruises.

(2) I was retained by the plaintiff’s law firm

The Ritchie Law Firm, a major central Virginia firm representing the plaintiff, retained me to:

  • Review photos that had been taken of the scene shortly after the accident
  • Take additional site photos
  • Create a graphical presentation that would show how, why and where this accident occurred

(3) The results

With the aid of the presentation I developed (below), the Ritchie Law Firm was able to obtain a pre-trial settlement from the defendant’s insurance company:

“I appreciate your willingness to come to the site and walk through the scenes with the client, so as to make sure that the presentation was accurate and effective.  Also, I found you to be prompt in your edits and easy to work with through email and phone calls.  The final product was very informative and instructive to our firm and the insurance company.  It all worked out very well for our client.”
