Wrongful death: Tractor trailer strikes pedestrian

Summary: My mission was to conduct a site analysis and develop analytical graphics that explain where and how a tractor trailer ran down a man who was attempting to clear a fallen tree from a roadway

Client: The Warren Firm (Charlottesville, VA)

Result: The client claims that my work was critical in presenting an effective case during mediation with the defendant’s insurance carrier.

(1) Background

A driver traveling on a two-lane highway got out of his small pickup truck to attempt to clear a fallen tree from the roadway. A tractor trailer, apparently traveling at a high rate of speed and unable to stop in time or swerve out of the way, struck the man, killing him.


(2) I was retained by the plaintiff’s law firm

The Warren Law Firm (Charlottesville, VA) retained me to develop key trial graphics & juror notebook materials.

My work ultimately involved:

  • Analyzing all evidentiary data and police reports
  • Consulting on, designing and producing analytical graphics depicting the scene, the reaction and stopping times and distances of the tractor trailer at various speeds, and a time-lapse depiction of what likely happened.

(3) The result

According to The Warren Firm, the presentation I created (below) helped enable it to effectively represent the victim’s family in the courtroom:

“I contacted Jon about helping me on a wrongful death case involving a client that was hit and killed by a driver of a tractor trailer.  Jon was able to take the police accident report, photographs, and other information we provided and create time lapse illustrations of the collision.  The illustrations were to scale an provided great visual evidence that supported our position that the tractor trailer driver was driving too fast for conditions.  Jon’s ideas and insight helped create images that were more powerful than I had envisioned.  The illustrations were a powerful part of our multi-media mediation presentation.”
